1. Introduction and Acceptance
These Terms of Service ("Terms") govern your use of twobrains.ai, an AI-powered decision analysis platform operated by Twobrains Inc., a corporation incorporated under the laws of Canada ("Company," "we," "us," or "our").
By accessing or using our service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our service.
For Quebec Users: These Terms are subject to Quebec consumer protection laws. Your rights under Quebec's Consumer Protection Act cannot be waived or limited by these Terms.
2. Description of Service
Twobrains.ai provides an AI-powered decision analysis platform that orchestrates moderated discussions between multiple AI models to help users examine decisions from multiple perspectives. Our service includes:
- Multi-AI Debates: Facilitated discussions between different AI models (currently OpenAI and Google Gemini) that analyze your decisions from various angles
- AI Moderation: An AI moderator that guides discussions and ensures balanced perspective exploration
- Decision Analysis Tools: Frameworks and tools to help structure and improve decision-making
- User Interaction: Interactive chat interface allowing you to participate actively in AI discussions
Important: Our service provides decision analysis and insights for informational purposes only. Final decisions and their consequences remain entirely your responsibility.
3. Account Registration and Eligibility
3.1 Eligibility
To use our service, you must:
- Be at least 13 years of age (14 in Quebec, 16 in the EU, or as required by local law)
- Provide accurate and complete registration information
- Have legal capacity to enter into these Terms
For Quebec Users Under 18: Parental or tutor consent is required as per Quebec's Act respecting the protection of personal information in the private sector.
3.2 Account Creation
You may register using:
- Magic link authentication via email
- Other authentication methods we may provide in the future
3.3 Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities occurring under your account
- Providing accurate information and keeping it updated
- Notifying us immediately at info@twobrains.ai of any unauthorized account use
4. Acceptable Use
4.1 Permitted Uses
You may use our service to:
- Analyze personal and business decisions
- Explore different perspectives on complex issues
- Improve your decision-making processes
- Engage with AI-generated insights for educational purposes
4.2 Prohibited Activities
You may not use our service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property or other rights
- Upload harmful, threatening, harassing, or illegal content
- Generate content that promotes violence, hatred, or discrimination
- Attempt to reverse engineer, hack, or compromise our systems

- Misrepresent your identity or affiliation
- Use the service for commercial purposes without our written consent (free tier users)
- Use the service in safety-critical environments where failure could result in death, personal injury, or severe property damage (including medical diagnosis, emergency response, aviation, or critical infrastructure)
4.3 Export Controls and Sanctions
You represent that you are not located in any embargoed country or on any restricted party list, and will comply with applicable export control and sanctions laws.
4.4 AI Content Guidelines
When providing input to our AI systems, you must not include:
- Personal information of others without consent
- Confidential or proprietary information you're not authorized to share
- Content that violates privacy laws or professional obligations
- Sensitive personal information as defined in our Privacy Policy
5. Service Availability and Modifications
5.1 Service Availability
We strive to maintain reliable service availability but cannot guarantee uninterrupted access. The service may be temporarily unavailable due to:
- Scheduled maintenance (with reasonable notice when possible)
- Technical difficulties or system upgrades
- Third-party service provider issues
- Circumstances beyond our reasonable control

Our service is currently offered free of charge during our beta period.

We may introduce premium features and subscription tiers in the future. When we do:

- Pricing will be displayed before any charges

The twobrains.ai platform, including software, algorithms, designs, trademarks, and content we create, is owned by Twobrains Inc. and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use our service according to these Terms.

You retain ownership of content you provide to our service. By using our service, you grant us a limited license to:

- Store your content as necessary to provide the service
- Use anonymized, aggregated insights to improve our service
7.3 AI-Generated Content
Content generated by our AI systems is provided for informational and analysis purposes only. You may use AI insights to inform your decisions, but:
- AI recommendations are not professional advice of any kind
- We make no warranties about accuracy or completeness
- You remain solely responsible for your decisions and their outcomes
- AI-generated content should not be considered as our opinions or recommendations
7.4 Copyright Complaints (Canada)
Canada uses a Notice-and-Notice system. If we receive a compliant copyright infringement notice about your use of our service, we may forward it to you and retain records as required by law. We may remove content at our discretion. Send notices to legal@twobrains.ai.
8. Third-Party Services and AI Providers
Our service integrates with third-party AI providers including OpenAI and Google Gemini. Your content may be processed by these providers as described in our Privacy Policy. By using our service, you acknowledge:

- We are not responsible for third-party provider actions beyond our reasonable control

Our AI-powered decision analysis is provided for informational purposes only and is not:

- A guarantee of decision outcomes or success
- A substitute for your own judgment, research, and analysis
- Comprehensive coverage of all relevant factors or perspectives
10.3 Decision Responsibility
You acknowledge that:
- You remain solely responsible for all decisions you make
- AI analysis may contain errors, omissions, or limitations
- You should consult appropriate professionals for important decisions
- Our service supplements but does not replace critical thinking

We are not responsible for:
- Actions or omissions of third-party AI providers
- Interruptions in third-party services

11. Limitation of Liability
11.1 Liability Limits
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TWOBRAINS INC.'S TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM (CURRENTLY $0 FOR FREE SERVICES).
11.2 Excluded Damages
WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:
- Lost profits or business opportunities
- Data loss or corruption
- Business interruption
- Reputation damage
- Poor decision outcomes
11.3 Jurisdictional Variations
Quebec Users: Nothing in these Terms excludes liability that cannot be excluded under Quebec law, including liability for intentional fault or gross negligence.
EU Users: Nothing in these Terms excludes liability for death, personal injury, fraud, or other liability that cannot be excluded under applicable EU law.
12. Indemnification
You agree to defend, indemnify, and hold harmless Twobrains Inc., its officers, directors, employees, and agents from claims, damages, and expenses (including reasonable legal fees) arising from:
- Your use or misuse of the service
- Your violation of these Terms or applicable law
- Content you provide to the service
- Your decisions made using or influenced by our service
- Infringement of third-party rights
This section does not apply where prohibited by applicable law.
13. Termination
13.1 Termination by You
You may terminate your account at any time by:

- EU Users: Laws of Ontario, Canada, subject to mandatory EU consumer protection laws
- Other International Users: Laws of Ontario, Canada
14.2 Jurisdiction
Canadian Users: Disputes will be resolved in Ontario, Canada, or your provincial courts if required by law.
Quebec Users: You may pursue disputes in Quebec courts as provided by Quebec law.
EU Users: You may pursue disputes in your local courts as provided by EU law.
Other International Users: Disputes will be resolved in Ontario, Canada.
14.3 Informal Resolution
Before initiating legal proceedings, we encourage contacting us at info@twobrains.ai to resolve disputes informally. We commit to good faith efforts to resolve issues promptly.
15. General Provisions
15.1 Entire Agreement
These Terms and our Privacy Policy constitute the complete agreement between you and Twobrains Inc. regarding the service.
15.2 Severability
If any provision is found unenforceable, the remaining Terms continue in full effect.
15.3 Language
Quebec Users: You have the right to receive and execute these Terms in French. Contact us at info@twobrains.ai for a French version.
EU Users: Where required by law, these Terms will be provided in your local language.
15.4 No Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
15.5 Assignment
You may not assign these Terms without our written consent. We may assign our rights and obligations without restriction, subject to applicable privacy law requirements.
16. Changes to Terms
We may modify these Terms to:

- Address legal or regulatory requirements
- Improve clarity or user protection
Notice of Changes:
